Agreement

These Terms of Service ("Terms") govern access to and use of Inkmark (inkmark.co), a business-to-business software platform operated by the Inkmark team. By creating an account or using the service, you agree to these Terms on behalf of your business.

The service

Inkmark provides digital loyalty stamp cards, staff tooling, customer card pages, push notifications, analytics, and related features for independent businesses. We may update features from time to time. Prices are listed in GBP unless otherwise agreed in writing for Enterprise customers.

Accounts and trials

You must provide accurate business and contact information. You are responsible for activity under your account and for credentials issued to staff. We offer a 7-day free trial on self-serve plans with no card required at signup. After the trial, continued use requires an active subscription or lifetime purchase where offered.

Billing and cancellation

Paid subscriptions are processed by Stripe. By subscribing, you authorise recurring charges according to the plan and billing interval you select. You may cancel through the billing portal; cancellation stops future charges but does not automatically refund prior periods unless required by law.

If you cancel, stamping and new sign-ups stop when your subscription ends (typically at the end of your current billing period). Customer loyalty card data is scheduled for deletion 90 days after your subscription ends unless you resubscribe. You are responsible for informing your customers where required by law.

Acceptable use

You agree not to:

  • Use Inkmark for unlawful, deceptive, or abusive purposes.
  • Attempt to bypass security, rate limits, or tier restrictions.
  • Upload infringing, harmful, or malicious content.
  • Resell or sublicense the platform without written permission.

Data and privacy

Our Privacy Policy describes how we handle personal data. You are the controller of customer loyalty data collected through your programs and must have a lawful basis to collect it (for example consent or legitimate interests, depending on your use case).

We use the following subprocessors to deliver the service:

  • StripePayment processing and subscription billing
  • ResendTransactional email (verification codes, password reset, onboarding, billing, and security notifications)
  • RailwayApplication hosting, database, and cache infrastructure
  • Cloudflare R2Logo and asset storage
  • SentryError monitoring and diagnostics

Availability and support

We aim for high availability but do not guarantee uninterrupted service. Support is provided by email at support@inkmark.co on a reasonable-efforts basis for paying customers.

Disclaimer and liability

Inkmark is provided "as is" to the maximum extent permitted by law. We are not liable for indirect, consequential, or lost-profit damages. Our total liability for any claim relating to the service is limited to the fees you paid to us in the twelve months before the event giving rise to the claim, except where liability cannot be limited under applicable law.

Governing law

These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, without prejudice to mandatory consumer protections that may apply to you if you are not using the service in a business capacity.

Account deletion

Business owners may delete their account from Settings. Deletion is permanent and removes programs, staff, customer cards, and loyalty history immediately. If you have an active subscription, cancel it in Billing before deleting your account. To request help, email support@inkmark.co.
